Information about cookies

Cookie information of CW Europe Group Marbella S.L (hereinafter referred to as “CW Europe Group Marbella S.L”, “we” or “us”) for the website www.cwibiza.com as well as for all its subpages (hereinafter collectively referred to as the “website”) valid as of August 15, 2022.

First of all, the most important thing:

You can partially or completely revoke your consent and the settings you have made when visiting the website and all its subpages via the Didomi SAS Consent Management Platform (hereinafter referred to as the “CMP tool”) used by us, at any time with effect for the future. To do so, please use the “Manage cookie settings” option at the bottom of the website.

I. What data does CW Europe Group Marbella S.L. process when using the website?

In principle, you can use the www.cwibiza.com website together with all of its subpages (hereinafter collectively referred to as the “Website”) without registering or actively providing personal data. For more information, please refer to our privacy policy, which you can find here, or to the privacy policies of the corporate websites of our respective licensee partners. You will find the privacy policies of our licensing partners at the bottom of each company’s page, which can be accessed via the URL www.luxuryvillasibiza.net.

When you visit the website, we or our licensing partners collect limited data about the device you are using and your usage behavior in connection with our offerings. Neither we nor our licensing partners can make an assignment of this data to an individual person. This includes the following data when you access a website:

Personal data transmitted by the users’ Internet browser each time they access the website and stored as part of log files, also known as server log files. This data includes: IP address (Internet Protocol address) of the accessing computer; name of the page accessed; date and time of access; URL from which the user accessed the page; number of data transferred; successful access status message; session identification number;

Personal data in the form of location data (GPS data, the so-called “Locate Me” function), which is transmitted by your Internet browser each time you have activated this setting from the browser in principle or application-based.

II. Use of cookies and other tracking technologies

1. What are cookies?

Like all other commercial websites, the website also uses so-called cookies and other tracking technologies (hereinafter collectively referred to as “cookies”).

Cookies are small text files that are stored locally in the main memory or on the hard disk of your computer or mobile device (hereinafter referred to as “terminal device”) and which serve a variety of functions and can process data for different purposes. If the respective website is reopened, the user’s browser returns the contents of the cookies and thus enables user recognition. Third-party technologies, such as scripts, pixels and tags that CW Europe Group Marbella S.L. integrates for advertising purposes, also install cookies on your terminal device. Some cookies are automatically deleted at the end of the browser session (so-called session cookies), others are stored in the user’s browser for a certain time or permanently and then automatically deleted (so-called temporary or permanent cookies). Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie by which Internet pages and servers can be assigned to the specific Internet browser in which the cookie was stored. This allows the Internet pages visited to distinguish the user’s browser from other Internet browsers; cookies cannot in principle identify you as a person. However, the cookie makes it possible to identify your terminal device.

A. Types of cookies

We use different types of cookies:

(i) So called technically necessary cookies

Firstly, we use cookies that are technically necessary for the operation of the website. Technically necessary cookies are essential for the operation of the website, without them the website could not be used or only to a limited extent. User data collected through technically necessary cookies are not used to create user profiles. This also includes temporary cookies (session cookies). They do not collect any data from your computer and are automatically deleted as soon as you close your browser.

Technically necessary cookies are also used for the use of our Didomi SAS Service Provider Consent Management Platform (hereinafter the “CMP Tool”) to obtain your consent to the installation of cookies and the use of other tracking technologies.

Technically necessary cookies are “strictly necessary” cookies in accordance with the ePrivacy Directive 2002/58 EC and do not require consent. For the scope of application in the Federal Republic of Germany, the legal basis for their use is § 25 II TTDSG (German Telecommunications and Telemedia Data Protection Act). If personal data are processed in this context, the legal basis is Art. 6 para. 1 sentence 1 lit. f) GDPR (legitimate interest).

(ii) So-called technically unnecessary cookies

In addition, there are cookies that are not technically necessary. These cookies serve a wide variety of purposes, such as website optimization, user profiling and displaying interest-based advertising. Basically, they can be said to be for analytics or marketing purposes.

If we use such cookies for analytics or marketing purposes, we process your data on the basis of your consent in accordance with Art. 6 para. 1 sentence 1 lit. a) GDPR. You provide us with this consent using the CMP tool. Alternatively, Art. 6 para. 1 sentence 1 lit. f) GDPR (legitimate interest) may also be the legal basis for such cookies for analytics or marketing purposes. Please refer to our CMP tool for more details (you can access it via the “Manage cookie settings” option at the bottom of the website). Here we have listed in detail for which purposes we use cookies for analytics or marketing purposes and on which legal basis. You will also find further explanations below.

B. Managing cookies in our CMP tool

You can inform yourself and decide for yourself which cookies when using the website, from which service provider / partner (so-called “providers”) are offered, which of your data is processed and whether you wish to give your consent.

To enable you to make this decision in an informed manner, we use a cookie consent management procedure (the CMP tool described above), with which your consents to the use of cookies or to the processing and providers mentioned in the cookie consent management procedure are obtained, you have the possibility to manage them and – if you wish – you can also withdraw them. The declaration of consent is stored so that you do not have to repeat the request and can prove your consent in accordance with legal obligations. The storage can take place on the server or in a cookie (so-called “opt-in cookie” or with the help of comparable technologies) in order to be able to assign the consent to a user or his terminal device. Subject to individual information on cookie management service providers, the following applies: The duration of the storage of consent can be up to 12 months. This involves the creation of a pseudonymous user ID and, with the date of consent, details of the scope of consent (e.g., which categories of cookies or service providers).

The CMP tool helps you to filter the various cookies, trackers and analysis tools used by us and, where applicable, our suppliers on a user-specific basis to obtain an overview, select them according to their purpose of processing and, if desired, disable them generally or individually. However, you cannot deactivate technically necessary cookies, trackers and analysis tools for the reasons described above.

To access this CMP tool (again, if necessary), click on “Manage cookie settings” (accessible through the option at the bottom of the website).

As explained above, you can use the website without cookies and other tracking mechanisms that are not technically necessary, both initially and subsequently. In this case, only cookies, trackers and analytics tools technically necessary for the use of the website will remain.

Consent information: Some of the services listed in the CMP tool are set up by our vendors or we transfer your data to these vendors. More details can be found in our CMP tool.

Consent information: Some of the services listed in the CMP tool transfer data to the United States. The data processing and protection of your data in the United States is not GDPR compliant. The services/suppliers are subject to U.S. law and may therefore be obliged to hand over data to U.S. authorities or secret services if the legal requirements are met. Risks to you are due, in particular, to the increased difficulty in law enforcement, lack of control in the further processing or transmission of your data and the aforementioned access by government agencies. You can also find more details in our CMP tool.

To exercise your cookie settings/opposition in this regard, please click on “Manage cookie settings” (accessible through the option at the bottom of the website).

C. Browser cookie management

You can also deactivate the storage of cookies through your browser settings and delete cookies already stored in your browser at any time. However, please note that the website or online offering may not function or may function in a limited way without cookies. We also recommend that you visit the website www.YourOnlineChoices.com, where you can obtain information and assistance regarding website tracking mechanisms. A centralized opt-out option for several tools, especially those of U.S. vendors, can also be accessed at the following link: optout.networkadvertising.org.

2. Summary of purposes for which we set cookies or also process personal data in the context of web tracking

a. To create individual offers of our services or the services of our licensee partners

Provided that you have given your consent in accordance with Art. 6 para. 1 lit. a of the GDPR, we set cookies or process personal data such as your IP address or work with unique identifiers (a unique identifier, or UID for short, is a unique identifier consisting of codes in the form of strings of numbers and letters) to inform you about our services. In doing so, we also take into account your preferences, which are derived from your usage behavior on our website.

In our CMP tool you will find these cookies in the following sections:

Select customized content

A Storage of and access to geolocation information for targeted advertising purposes

b. Usage profiling based on statistical analysis to tailor the website to your needs

We need statistical information about the use of the online offer on the website to make the website or its contents more user-friendly and to perform market research or outreach analysis. We use web analysis tools (“tools”) for this purpose. Usage profiles are created with the help of analysis cookies or by evaluating your log files. The providers of these tools process your data as processors in accordance with our instructions and not for their own purposes. The tools do not use users’ IP addresses or shorten them immediately after collection.

The legal basis may be your consent (if we process your personal data, Art. 6 para. 1 lit. a) GDPR; if we use cookies and do not process personal data, the legal basis is the ePrivacy Directive 2002/58 EC or, within the scope of application of the Federal Republic of Germany, Section 25 II TTDSG). In addition, CW Europe Group Marbella S.L. may also have an overriding legitimate interest in the design of the website according to user demand and habits and in the statistical evaluation of the website. The legal basis for the data processing is then Art. 6, para. 1, let. f) of the GDPR.

For the aforementioned purposes, we use cookies for the website and subpages, both our own cookies and those of third-party providers, which we transmit to your computer via your web browser. These enable our systems to distinguish your browser from others. On the one hand, we send you so-called persistent cookies. On the other hand, we use so-called session cookies, with the help of which you receive a session ID during your visit to our pages, enabling us to distinguish you from other visitors to the website.

In our CMP tool you will find these cookies in the following sections:

  • Storing or accessing information on a device
  • Measuring content performance
  • Developing and improving products
  • Use market research in order to generate audience information
  • Measuring the performance of ads
  • Select basic advertisements
  • Use accurate geographic location data
  • Actively analyze the characteristics of the device for its identification

In our CMP tool, you can also find the partners we work with in alphabetical order.

Some of the services listed in the CMP tool transfer data to the United States. Data processing and data protection in the United States does not comply with the GDPR. The services are subject to US law and may therefore be obliged to hand over data to US authorities or secret services if the legal requirements are met. The risks to you are due, in particular, to the increased difficulty of law enforcement, the lack of control in the processing or transmission of data and the aforementioned access by government agencies. Some providers, such as Google, may also process data for their own purposes. In these cases, the data processing is based on your consent, Art. 6, I let. a) of the GDPR.

You can also find more details in our CMP tool (accessible through the “Manage cookie settings” option at the bottom of the website).

3. Links to social networks

Our website contains partial links to the sites of the most important social networks (e.g. Facebook and Twitter). In this sense, these are not social media plug-ins, but links, where personal data is not transmitted to the operators of the social networks.

III. Transfer of your personal data and, if applicable, transfer to non-EEA countries

Please refer to the information contained in our CMP tool to determine the extent to which we share personal data with our partners and whether these partners are based in non-EEA countries.

Recipients of personal data may be located outside the EEA/UK. Where personal data is transferred to locations outside the EEA/UK, we will ensure, as required by law, that your data protection rights are adequately protected, either because the European Commission has decided that the country to which the personal data is transferred ensures an adequate level of protection (Art. 45 of the GDPR) or the transfer is subject to adequate safeguards (e.g. standard contractual clauses) of the European Union agreed with the recipient (art. 46 of the GDPR), unless the GDPR provides for an exception (art. 49 of the GDPR). In addition, where necessary, we intend to agree additional measures with recipients to ensure an adequate level of data protection. Copies of the adequate protection measures (where we rely on them) and a list of recipients outside the EEA/UK may be requested. Please note that these copies may be redacted with information hidden where necessary to protect trade secrets or other confidential information.

IV. Storage and deletion of data

CW Europe Group Marbella S.L. stores your personal data for as long as necessary to achieve the purposes for which the data is collected and processed, including any retention period required by applicable law (e.g. retention of accounting records). Please refer to our CMP tool for more details on retention periods.

Our privacy policies provide information about our responsibilities, our contact details and your rights in relation to data processing.
